Before experiencing, purchasing, or using any services on Temp3, Customers need to ensure that they have carefully read and clearly understood these General Transaction Terms and Conditions with the following contents. The content of these General Transaction Terms and Conditions constitutes a legally binding agreement between the Customer and Temp3, applicable to the Customer's access, use, and purchase of any services on Temp3.
By registering an account to experience and use the services on Temp3, Customers agree to be bound by these General Transaction Terms and Conditions.
1.1
Temp3: means the website and landing page builder https://temp3.io
1.2
Service: means the products, services provided by Temp3 to Customers on Temp3.
1.3
Terms and Conditions: means this General Trading Terms and Conditions and updated, supplemented, and changed versions of the General Trading Terms and Conditions from time to time, drafted based on current legal documents of Vietnam.
1.4
Customers: means organizations and individuals who register accounts, log in to Temp3, experience, buy, and use Services on Temp3, including: (i) all individuals aged 18 years or older, have appropriate civil act capacity to perform transactions in accordance with Vietnamese law; and (ii) all organizations are legally established and/or operating in accordance with Vietnamese law.
When referring to the Customer, it means referring to the owner, or the party authorized by the owner to manage and use the Temp3 Account, including the Customer's employees for institutional Customers.
1.5
Order: means an electronic document confirming that Customer has made a transaction to purchase Services on Temp3.
1.6
Customer Care Department: means the channel to support, guide, and answer Customer questions related to activities on Temp3.
2.1
Terms and Conditions will apply to any and all activities of Customer experience, purchase, and use of Services on Temp3.
2.2
Customers register a trading account according to regulations and instructions on Temp3 from time to time (“Temp3 Account”) to experience, use, and purchase Services. The Service will be specifically connected to the Customer's Temp3 Account.
a.
Temp3 will proceed and complete the provision of the Services that the Customer has purchased by upgrading the Customer's account to the corresponding Service package that the Customer has purchased.
b.
Estimated time for service provision is within twelve (12) hours from the time of receipt of Customer's payment. Customer can use the Service as soon as the Account is upgraded.
c.
Geographic limitations for service provision: Temp3 delivers nationwide.
d.
The Temp3 will provide electronic invoices upon request to the Customer by sending them to the Customer's registered email to receive invoices.
e.
In case there is a delay in delivery compared to the expected delivery time as specified in point a above, the Customer can cancel the Order if desired.
f.
Temp3 will send a notice to the Customer before the date the Service package purchased by the Customer expires. If Customer does not pay the Service Fee to renew the Service, the Website and Landing Page that Customer has published will remain active and Customer's customers will still be able to access the page, however Customer will not be able to use it. Use the tool to edit this page or create a new page. Customer's Website and Landing Page data (including photos and content) are still saved in the system, back-up for 1 year. Any time the Customer renews, the old information of the Landing Page will still remain.
4.1
To ensure fairness and benefits for Customers, Temp3, at its discretion, has the right to apply restrictive conditions in the implementation of promotional programs (“Promotions”), including but not limited to the following conditions:
Limits on the number of Services per Promotion, which may be per Order; limits per Customer and/or account; Limit the purpose of purchasing the Service (not allowed to do business, buy and resell, transfer, transfer in any form, etc.).
Other limited conditions are set by Temp3 and/or merchants collaborating to implement the Promotion Program and are specifically stated in the content of the Service and/or detailed regulations in each Promotion Program.
Other regulations are stated in the relevant policies (if any) posted on Temp3 from time to time.
According to the provisions of this Term, Temp3 has the right not to confirm, refuse, cancel, or revoke delivered Services and/or Promotions applied to Orders when it notices signs of violate any regulations of the Promotion Program, related policies and/or provisions in this Article and/or other relevant policies posted onTemp3 from time to time.
5.1
The Customer has the obligation to commit and ensure that the information the Customer provides to register and log in to the Temp3 Account is accurate, complete and always maintained accurately, completely and updated for the Customer Temp3.
5.2
The Customer is solely responsible for all activities arising from and related to the Customer's Temp3 Account.
5.3
Customers are obliged to keep their Temp3 Account login information confidential, including login name and password. In case of any or suspicion that the Customer's Temp3 Account is used or logged in illegally, or Temp3 Account information is leaked, the Customer needs to immediately notify Temp3 for assistance in handling. For clarity, Temp3 will not be responsible for any loss or damage arising in this case.
5.4
If the Temp3 Account is terminated, the right to access and use the Service will also be terminated.
5.5
Other rights and obligations are as detailed in other contents of these Terms and Conditions.
6.1
The Services include without limitation any products, software, content, designs, applications, tools and related products, including modifications, updates, enhancements of the Service are all intellectual property rights of Temp3.
6.2
Customer is responsible for all content, images, documents, designs, data that Customer uploads, publishes, displays, connects, links and/or relates to the Service. that the Customer uses and the Customer's Temp3 Account. Temp3 has the right to delete any content that violates the provisions of these Terms and Conditions, relevant laws and at its sole discretion.
Before Customers purchase the Service, Temp3 has provided Customers with free Service to experience the product, therefore the Service cannot be exchanged or returned in any case.
8.1
It is strictly prohibited to engage in any acts through the use of the Service, posting, sharing or publicizing the following content:
a)
Sending spam, cyber attacks;
b)
Organizing, operating, colluding, inciting, bribing, deceiving, luring, training, and coaching people against the State of the Socialist Republic of Vietnam;
c)
Distorting history, denying revolutionary achievements, destroying national unity, insulting religion, gender discrimination, and racism;
d)
False information causes confusion among the people, causes damage to socio-economic activities, causes difficulties for the operations of State agencies or people performing public duties, and infringes upon legitimate rights and interests. of other agencies, organizations and individuals;
e)
Prostitution, social evils, human trafficking; Posting lewd, depraved, and criminal information; destroying the nation's fine customs and traditions, social ethics, and community health;
f)
Inciting, enticing, or inciting others to commit crimes;
g)
Interfere with or sabotage the features of the Service and the security of Temp3;
h)
Upload or transmit viruses, malware...
i)
Infringe the rights of any third party.
j)
Violate any other legal regulations and/or violate cultural and social standards.
8.2
In case of detecting or suspecting any behavior as specified in Term 10.1, Temp3 has the right to immediately suspend the violating/suspected Temp3 Account for verification.
In case the Customer does not stop the violation according to Temp3's notice, the Customer agrees that Temp3 has the right to stop the Temp3 Account violating the provisions of this Term 10.1 until the violation stops. Downtime in this case will be counted toward the Customer's Service usage term.
Temp3 Account will be terminated if the violation is committed 02 times or more or the violation is not stopped within 07 days from the date of notice of violation by Temp3. Temp3 does not refund Fees in this case.

The resolution of Customer complaints will be carried out according to Temp3's Complaint Resolution Policy as follows:
9.2 Complaint Resolution
Temp3 is always responsible for receiving and handling Customer complaints related to transactions at Temp3. When complaints or disputes arise, Temp3 promotes negotiation and conciliation solutions between the parties to maintain relationships and customers' trust in the quality of our services.
The complaint resolution process is carried out through the following steps:
Step 1: Customers make complaints about goods and services purchased on Temp3 via:

Step 2: The Customer Care Department will receive complaints and contact to clarify the Customer's requests as soon as possible and no more than 5 working days from the date of receipt of the request. bridge. Depending on the nature and extent of the incident, Temp3 will take specific measures to support Customers in resolving complaints and disputes.
Step 3: Temp3 may request the Customer to provide information and evidence related to transactions and Services to verify and clarify the case and take appropriate action.
During the process of processing Orders/complaints, if Temp3 detects and evaluates that a customer has abused promotional terms during the ordering process on Temp3, Temp3 will be responsible for notifying the customer. If the customer continues to commit this violation, Temp3 has the right to refuse to process the customer's Order/complaint.
The Services provided are software, software services and other products without any warranty.
11.1
Regulations on the security of all Customer information and Customer payment information are implemented in accordance with the Personal Information Security Policy and payment security policies posted on Temp3 from time to time.
11.2
For any information relating to Temp3 and/or the Services, Customer will contact Customer Care for guidance and support. Any action of disclosing and/or intentionally spreading information that is detrimental to Temp3 will be considered a violation of this confidentiality regulation and must be held responsible according to the provisions of law.
12.1
In any event, Temp3 is not responsible for: any damage, loss, or loss related to and/or arising from the use of the Service or the inability to use the Service.
12.2
Any compensation and/or any other liability of Temp3 (if any arises) shall be limited to a maximum of the value of that Order.
12.3
During the use of the Service, some problems will arise and Temp3 does not guarantee and is not responsible for:
Problems/errors arise, Services are interrupted;
Results from Customer's use of the Services;
13.1 Temp3 reserves the right to make the final decision in the following cases:
a)
Promotions apply to the Services, conditions, terms, regulations and other policies related to Promotions.
b)
Handle complaints and resolve disputes of Customers related to the Service and services arising in transactions on Temp3.
13.2 For the cases in Term 15.1, the Customer will not complain or sue about the Temp3's decisions.
14.1
Temp3 reserves all rights, including intellectual property rights, to Temp3's content. Temp3 does not grant the Customer any license or property rights regarding the content of Temp3.
14.2
Content posted on Temp3 is for Customer's personal reference purposes. Customers may not download, copy, use, reproduce or reference any content for business or commercial purposes.
14.3
Temp3 reserves the right to disable at any time any account, username and/or password chosen by the Customer if (in Temp3's opinion) the Customer fails to comply with the Terms. And these Conditions.
14.4
Temp3 reserves the right to suspend operations, adjust or repair Temp3 at any time.
15.1
The policies and regulations referenced in the content of these Terms and Conditions are an inseparable part of these Terms and Conditions.
15.2
When accessing, creating and confirming an Order on Temp3, it means that the Customer has read, understood and agreed to all contents of the Terms and Conditions. Temp3 has the right to change, edit and supplement the content of these Terms and Conditions at any time. Changes, edits and supplements are carried out in accordance with relevant laws and will have consequences, takes effect after being officially updated on Temp3. The Customer's continued transaction after the changes to the Terms and Conditions take effect means that the Customer has read, understood and agreed to the contents of the Terms and Conditions after being updated. Temp3 notes: Customers please update regularly and read these Terms and Conditions carefully before making transactions.
15.3
The obligations of Temp3 and the Customer are detailed in the provisions of these Terms and Conditions.
15.4
These Terms and Conditions and all issues arising in the contractual relationship between the Temp3 and the Customer are governed and interpreted in accordance with any local goverment's laws. Any disputes, differences, complaints arising from/or related to the content of these Terms and Conditions, transactions through Temp3 will be resolved through negotiation in good faith within three months. Twenty (30) days from the date the dispute arises, if it cannot be resolved through negotiation within the time limit, the dispute will be resolved at the competent State agency.
15.5
If any content of these Terms and Conditions is considered by a competent authority to be invalid or unenforceable in whole or in part, the validity of the other contents of the Terms and Conditions shall be deemed to be invalid or unenforceable. This is not affected.
